Scott County judge to rule on Eagan panel

A Scott County district judge heard arguments Friday on whether Eagan Charter Commission vacancies can be filled by the City Council, whose members hope to use those appointments to dissolve the 13-member board. Chief District Judge William Macklin took the matter under advisement without saying when he might rule. State law gives the chief judge in a judicial district the authority to appoint members to a charter commission and to fill vacancies. Since November, when 91 percent of Eagan residents rejected a proposed city charter, Mayor Mike Maguire and other City Council members have urged the Charter Commission to disband. When it refused, the council announced that eight commissioners were ineligible to serve because of expired terms or failure to sign their oath of office, and appointed two council members to the commission. Macklin then ordered the council to stop until further notice
